Terms of Service
Official MAYAKA'AL DIGITAL public policies. Package agreements and the Custom Website Agreement remain authoritative for package-specific purchase terms where more specific.
These Terms incorporate YAKA-approved sitewide business rules together with previously approved package-specific agreements (ASIS-v1.0, DIY-299-v1.0, DFY-699-v1.0) and the approved Custom Website Agreement for Custom Build. Policy version: TOS-v1.0-2026-10-15.
1. Agreement and scope
These Terms of Service (“Terms”) govern the general customer relationship with MAYAKA'AL DIGITAL, including use of commercial entry points such as account creation, MY MD PROFILE, package selection, and related MAYAKA'AL DIGITAL systems and services made available to the Client.
2. Umbrella Terms and package-specific agreements
These public Terms govern the general customer relationship. Package-specific agreements supplement these Terms. Where a package agreement contains a more specific provision concerning that package, the package-specific provision controls for that issue.
When a Client purchases AS-IS, DIY, or Done-For-You through MY MD PROFILE, the applicable Package Agreement presented at acceptance supplements these Terms for that purchase. Custom Build projects are governed by the separate Custom Website Agreement inside MD CONSULTATION, which likewise supplements these Terms and controls where it is more specific to that engagement.
3. Proprietary platform (from approved package agreements)

MAYAKA'AL DIGITAL retains all rights in its proprietary platform, tools, templates, systems, and technology (including MY MD PROFILE and MD SITE MANAGER).
4. Payment and fulfillment (package routes — approved language preserved)

Package payment is due after electronic acceptance of this Agreement and before fulfillment continues. Payment is processed through the PROFILE payment flow (Stripe). Fulfillment begins after successful payment confirmation.
Dollar amounts remain those configured for each package (including ASIS at the authoritative $149.00 USD). Custom Build uses its own milestone schedule in the Custom Website Agreement.
5. Electronic acceptance (approved language preserved)

By checking “I have read and agree” and confirming acceptance, the Client electronically accepts this Agreement. The executed record (including version and timestamp) is stored permanently and is not altered by later template updates.
6. No business-results guarantee
MAYAKA'AL DIGITAL does not guarantee customer revenue, sales, leads, traffic, search rankings, business performance, or other commercial outcomes from its websites or services. Results depend on factors outside MAYAKA'AL DIGITAL’s control, including the Client’s business, content, marketing, operations, and market conditions.
7. Acceptable use
MAYAKA'AL DIGITAL services and systems may not be used for unlawful, fraudulent, infringing, malicious, or abusive activity. Serious violations may result in restriction or suspension of access or services, subject to the applicable agreement and applicable law.
8. Dispute resolution
Before escalating a dispute, the Client and MAYAKA'AL DIGITAL must first make a good-faith attempt to resolve the matter directly with MAYAKA'AL DIGITAL. These Terms preserve legally available remedies. They do not require mandatory arbitration.
9. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles that would require application of another jurisdiction’s laws, except where a more specific package agreement expressly provides otherwise for that package.
10. Policy status
- These Terms are the FINAL production Terms of Service for MAYAKA'AL DIGITAL.
- Package-specific agreements remain preserved and continue to control where more specific.
- Privacy Policy and Refund Policy are published as FINAL companion policies.
- Refund Policy business rules apply for standard packages; Custom Build agreement rules remain controlling for Route #4.
